Simple assault at G-Lot

On Oct. 4, an officer was sent to G-Lot near the Physical Plant Department in reference to an assault call, according to a UNMPD report.

After work, an employee approached the victim, who was also an employee, while he was outside of his vehicle in the parking lot, the victim stated in the report. Over the past four months, the victim has had disciplinary issues with the accused, but this was the first time an interaction has reached this level of confrontation, and the situation appeared to be growing worse.

The conduct appeared menacing and unfriendly, the victim said, stating that the employee angrily spoke in English and Spanish. The accused threatened to punch the victim several times and placed his hand on the victim’s shoulder, attempting to begin a fist fight. During the encounter, several other employees watched while making rude hand gestures at the victim.

The victim, who said he did not react to the contact, was told to complete a written statement of the incident. There are currently no pending charges.

Verbal assault

On Oct. 11, a female victim met with an officer at UNMPD in reference to an assault, according to a police report. A student, who had been disruptive during class in the past, was being disrespectful toward another student after class, the victim said.

The victim confronted the disrespectful student — now a suspect — stating it was not right to speak to the other student in such a manner. The suspect began shouting at the victim roughly one inch away from her face, making the victim feel threatened.

She said she felt that if she did not leave, the suspect would physically harm her. The victim provided a description of the suspect and a written statement, but did not know the suspect’s name.

The professor, who the victim identified as a witness, was contacted by UNMPD through email.

Alleged sexual assault reported near Mitchell Hall

On the evening of Oct. 13, officers were dispatched to the SUB, where a female student made an emergency phone call, stating she was sexually assaulted near Mitchell Hall that day, according to a UNMPD report.

She and a male acquaintance she had known for a few years decided to meet at the Duck Pond after she rode the bus to UNM from CNM, she said in the report.

However, the female’s mother later told police she dropped her daughter off at the Duck Pond. After meeting up with the male, who she first met during a UNM class, the two walked around campus holding hands, the female said. The encounter was consensual until he pulled her into a building she did not recognize, took her to the corner of a hallway and said he wished to take her to his home, she said in the report.

She “froze up” when he kissed her and pushed himself against her, attempting to remove her clothing and touching her inappropriately, the female said. She asked him what he was doing, and he apologized; then, she called a friend and told the male she needed to leave to help that friend, she said.

Although the female was able to show officers four phone calls she made with the male that day, she did not have text messages available. The female, who spoke with officers at the SUB, agreed to be transported to UNMPD to wait for her mother. She said she was unsure about taking the incident to court.

An officer provided her with a LoboRespect card, stating that she did not need to make decisions immediately, but she would be contacted later that week to discuss filing charges. Her mother said counseling would impact her daughter positively.

Officers used the cell phone number the female provided to contact the male, who agreed to visit the station that same day. The male, who had a strong odor of alcohol, said he and the female met on Tinder around the beginning of October and had been messaging one another since; he showed the officer these messages.

He and the female agreed to meet at the Duck Pond and proceeded to walk around campus holding hands, when the female disclosed she had previously been sexually assaulted in Mitchell Hall, he said in the report. The two then walked into Clark Hall, entered the corner of a hallway and started kissing, the male said.

She was grabbing and kissing him and appeared to enjoy it, he said. He touched her sexually, but the two stopped when they heard someone enter the building, the male said. They walked back to the Duck Pond when the female received a message from a friend and stated she needed to leave, he said.

According to the report, he saw her walk toward Zimmerman Library as he left for his home, the male said. He sent the female a text message, asking why UNMPD contacted him, he said. The officer advised that he should no longer contact the female. The male admitted to drinking after seeing the female when he returned home.

All recorded statements were tagged as evidence, and the case has been closed.
