Albuquerque ideal for those fleeing discrimination

Some Hispanic immigrants and families may soon call Albuquerque their new home.

As a result of Arizona’s “draconian” new immigration law, undocumented immigrants and legal Hispanic citizens are looking to escape the state, said Ralph Arellanes, director of New Mexico’s League of United Latin American Citizens (LULAC).

“They’re leaving Arizona because of fear — fear of being racially profiled and arrested,” he said. “In New Mexico, they have a lot more liberty.”

Albuquerque area realtor Tracy Venturi said she has talked to a few families choosing to move to New Mexico because of immigration issues in Arizona.

“We have had a couple of folks from Tucson who state that part of why they want to get out is because of illegal immigration problems,” she said. “But they were looking to move before the latest stuff came up. It has to do with lots of things, not just (the immigration law).”

The Arizona law states that police officers “without a warrant, may arrest a person if the officer has probable cause to believe that the person has committed any public offense that makes the person removable from the United States.”

New Mexico, Utah and Washington are the only states that issue driver’s licenses to undocumented immigrants, according to Stateline.org. New Mexico issued about 80,000 driver’s licenses to foreign nationals, a group that includes undocumented immigrants, said S. U. Mahesh, New Mexico Taxation and Revenue spokesman.

Arellanes said immigrants will also likely travel to other surrounding states, including California, Nevada and Colorado. He said there are reasons immigrants and Hispanics concerned about the possibility of racial profiling would be drawn to New Mexico, especially Albuquerque.

“We’re a very progressive state as far as Hispanic civil rights,” he said. “In terms of education, New Mexico is much friendlier to Hispanos and immigrants than Arizona.”

Arellanes said Albuquerque has the best economy of any city in the state, which means more job availability.

Still, Arellanes said LULAC and other local Hispanic organizations won’t know the full impact of the Arizona law until it is enacted July 29.

“The immigrant community really lives in the shadows,” he said. “They don’t want to let other people or other groups know that they’re coming. They’ll just come.”

The Justice Department filed a lawsuit Tuesday against the state of Arizona to prevent the law from going into effect. The Justice Department claims that the Arizona immigration law competes with federal ability to control illegal immigration, according to a New York Times article published July 6.

A policy enacted by Mayor Richard Berry in May allows Immigration and Customs Enforcement officials to work at the Prison Transport Center to check the immigration status of all people who are arrested.

Arellanes said the Hispanic community is worried about the new policy, but it is still much less severe than the Arizona law.

“Yeah, that’s going to be a concern for immigrants coming from Arizona, but it’s not as bad as what Arizona is doing right now,” he said. “Arizona is doing something that is downright illegal and unconstitutional.”

The policy was enacted to reduce crime in Albuquerque, said T.J. Wilham, spokesman for Berry, and shouldn’t be compared with the Arizona law.

“What we’ve done is not an immigration policy,” he said. “It’s not an immigration issue. It’s a public-safety procedure.”
Wilham said the policy will not lead to racial profiling because only ICE officials can conduct the immigration status checks, and witnesses and victims of crimes won’t be checked, he said.

“Anyone comparing what we’re doing to Arizona — we would have contention with that,” he said. “We have not written any laws. What we have done is we have developed a procedure that allows ICE to be in the Prison Transport Center.”

Wilham said everyone who comes through the Transport Center will be screened by ICE, which also curbs racial profiling.

First and foremost everyone reading this article will observe the extreme bias demonstrated by the author. We are not writing, talking, or debating immigration. The topic is illegal immigration, and leaving out this important descriptor thoroughy demeans and damages the writer’s points and positions. Societal laws are to be enforced, immigration relativity is not the law nor is it what we see with the vast number of Mexican illegal immigrants.

“Racial profiling” is an obtuse description of the process of identifying, locating and deporting illegal Mexican immigrants and we all understand that it is not only a liberal extremist term, but a political endeavor. If you have a crime that has been committed, and you need to identify the culprit(s) you look at the crime report and talk to the witness first. Then you form a line up. If the witness indicates that the crime was committed by a middle aged black male you don’t need to place Native Americans, women and children in the line up. That’s a no-brainer as they say.

Arizona is perfectly within their rights and capable of handling immigration aa they have decided to do. This is why the democrats are concerned with the latests strategy the feds have enacted. Prioritizing illegal immigrant’s rights above those of citizens is wrong, and contributes to the potential loss of legislative seats.

There is a problem in Mexico that needs to be solved. The problem is that Mexico is a poor country, a third world country, and cannot support it’s population. These people need help; and I believe we should help them. There are many strategies. One example to bring this into the light is to imagine if all of Africa and a host of other third world countries were all bordering the USA. It would be encumbent upon our country to help them, and we do so by countless humanitarian efforts all the time. However, it would be foolish to open the borders and invite everyone into the USA because we would then lose our ability to provide aid. We would essentially “become” like those countries who are to poor and helpless to take care of their own.

We must enact strategies to assist Mexico and help the millions of poor. We must not stumble into a false strategy of inviting everyone into the USA based on some misguided ACLU racial profiling nonsense. Racial profiling was never meant to be an obstacle to enforceing the law, it is meant to protect the innocent.

A realtor’s “couple of families” anecdote is presented as an argument from the particular to the general— which is logically fallacious. This article offers nothing but fanciful speculation to suggests illegals are “fleeing” Arizona.

Of course, if illegals are fleeing law enforcement, then that is yet another reason to support Arizona— not aid and abet law breakers.

Funny how Leftist idiotarians pretend border security and enforcement is merely about targeting Mexicans and “racial profiling” (as opposed to stopping illegal human and drug trafficking)— while at the same time indulging in denial of the Hezbollah threat along our border. Being that New Mexico grants Drivers Licenses to people who are not even suppsed to be in this country,, this story is plane B.S.
I’m a gringo born in Santa Fe, grew up Albuquere and most of my friends are Beaners ( we call each other those names so it is OK ),,the real issue is —- When will America get a Back Bone and start enforcing Laws that are already on the books—and do like Arizona is prepairing to—ACT.

This is directly from the amended Arizona statute HB 2162, § 3; 11-1051 B :“For any lawful contact STOP, DETENTION OR ARREST made by a law
43 enforcement official or a law enforcement agency of this state or a law
44 enforcement official or a law enforcement agency of a county, city, town or
45 other political subdivision of this state IN THE ENFORCEMENT OF ANY OTHER LAW
H.B. 2162 – 4 – 1 OR ORDINANCE OF A COUNTY, CITY OR TOWN OR THIS STATE where reasonable
2 suspicion exists that the person is an alien who AND is unlawfully present in
3 the United States, a reasonable attempt shall be made, when practicable, to
4 determine the immigration status of the person, except if the determination
5 may hinder or obstruct an investigation. Any person who is arrested shall
6 have the person’s immigration status determined before the person is
7 released. The person’s immigration status shall be verified with the federal
8 government pursuant to 8 United States code section 1373©. A law
9 enforcement official or agency of this state or a county, city, town or other
10 political subdivision of this state may not solely consider race, color or
11 national origin in implementing the requirements of this subsection except to
12 the extent permitted by the United States or Arizona Constitution.

That folks is the truth. Anyone claiming what TRICIA did is not quoting the Arizona law, but telling an untruth.

NM being friendly to illegals is correct at a huge cost to the working taxpayers of the state. The cost per student of the kids who walk across the border into the Columbus, NM schools exceeds $10,500.00 per year, plus the free breakfast and lunch programs and health care.

Eric Holder inquisitor to President Obama has filed a federal lawsuit, to immobilize Arizona laws that would have promoted in cleaning out drug dealers, skin slavers and illegal aliens by the hundreds of thousands. Americans must stop the rampage and carnage in this border state, that has suddenly been illuminated by the Arizona policing law SB 1070. Governor Brewer has the majority of Americans on her side, whereas the Liberal progressives are trying to turn Arizona into a cesspool just like the Sanctuary State of California. So the resonating question is, if Arizona’s law is unconstitutional, then how come they have not sent ICE and federal Marshals with a writ to crush the policies implemented in San Francisco and California as Sanctuary Cities? If this is not a brazen violation of Federal immigration law, then what is? Doesn’t it say that aiding and abetting illegal aliens imposes heavy fines and imprisonment? Just a point, we Americans illegally hire illegal aliens. There are laws that make both these activities illegal. We only go after the illegal aliens. Also, we have laws and policies that allow illegals to use our services like schools and healthcare. The illegals did not put those laws in place… we did! Lets own up to the fact that we have our part to play in this problem.

ALEX, I agree. Go to Columbus, NM and watch the parade of kids coming into the school and community center from Mexico. The cost to school those kids, give them breakfast and lunch and special services is borne by the taxpayers of NM and the country.

All that is necessary is to demand the NM congressional delegation – all 5 of them – put forth legislation to make paying for schooling and meal programs an illegal act if any Federal dollars are being spent.

PHILIP, I agree. While I am writing our NM congressman. Can you please write them as well with regards to the problem of illegal hiring of illegal aliens. This should discourage the flow of immigration since there would then be no money to be made by illegal aliens.

Jesus told us to help others. NOT to have the government do what we should do. When you read the Gospel of the Good Samaritan you hear Jesus praise the Samaritan for helping another. Jesus did not tell him to get a government worker to help that poor fellow.

If you do not like the failure of churches to pay taxes, tell your members of Congress to change the law. Also tell them to tax the $80/M of profit Planned Parenthood made doing abortions and the millions the Sierra Club took in that are exempt from taxes. FRANCISCO, I do not believe any organizations should be exempt from taxation. Demand the end of ALL non-profits and tax exemption for donations. Are you willing to stand for that?

ALEX, interesting you raise this issue. The Obama adm is cracking down on businesses with employee audits. When they find illegals working they demand the immediate firing of those employees and fine the company.
