Richard Berthold, in his column published in the Daily Lobo on Wednesday, is correct in pointing out the illegal actions of the three former administrators who are now state officials. They cannot be paid twice for state jobs. They cannot be on the UNM payroll and receive pay for another state job. This is illegal.
In addition, it violates UNM policies, which are based on state laws. UNM policy 3735, for example, requires such officials to resign from the University, or, if approved, they can take an unpaid leave of absence. UBP 3715 states that employees of the University shall not accept any favor or gratuity from any person, firm or corporation which is engaged in or attempting to do business with the University or any agency of state or local governments, which might affect the employee's judgment in the impartial performance of duties.
In addition to the violation of University policies, a careful reading of Governmental Conduct Act, Section 10-16-1. et seq., NMSA 1978, may reveal the illegality of this double dipping. These administrators need to return all such money received from UNM while working for the state government. In addition, the people who authorized these payments should be charged with such crime
and fired.
